Terms of Service

For diners

• Your order is with the restaurant. Prices, what is available, the food, the service, refunds and discounts are the restaurant’s responsibility. TapNaDine passes your order to them.
• You pay the restaurant directly, in cash or through its own GCash, Maya or other QR. TapNaDine never receives, holds or refunds your money.
• The bills you see are order summaries, not official receipts or invoices. They are not valid for claim of input tax. Ask the cashier for your official invoice. Senior citizen and PWD discounts are applied by the cashier when you pay.
• Menu prices include VAT where the restaurant is VAT-registered. Any service charge is shown before you order and listed separately on your bill. Tips are optional.
• Order honestly. Order only for the table you are at. Don’t place fake orders, change or share table links to order from elsewhere, or interfere with the service. A restaurant may refuse or cancel an order.
• Feedback goes privately to the business. Every guest is offered the business’s Google review page, whatever the rating. Don’t post anything unlawful, abusive or untrue.

For businesses

• Accounts. Keep staff sign-in details secure. You are responsible for what is done with your accounts; tell us right away if one may be compromised.
• Fees. The subscription fee is what we agreed for your plan, billed monthly. NFC table cards are hardware sold separately. We may suspend a business whose payment is overdue, after telling the account owner.
• Your obligations. Keep menu prices accurate and VAT-inclusive where you are VAT-registered, and set your VAT status correctly in Settings. Issue official invoices from your own BIR-registered system — TapNaDine is an ordering tool and does not issue them. Apply senior citizen and PWD discounts as the law requires, and distribute service charges to your staff under Republic Act No. 11360.
• Availability. TapNaDine depends on internet connections — yours, your diners’ and ours. We work to keep it running, but we can’t promise it will never be interrupted, so keep a way to take orders by hand.

Processing diners' personal information

For personal information about your diners — orders, table sessions, feedback — your business is the personal information controller and Zenigan Software Studio is your personal information processor. We will:

• process it only to provide TapNaDine to you, following your instructions through how you set up and use the service;
• keep it confidential, and limit access to people who need it to run the service;
• protect it with reasonable organizational, physical and technical security measures;
• use only the service providers listed in the Privacy Notice, under terms that protect the information, and remain responsible for them;
• help you answer requests from diners who exercise their privacy rights;
• tell you without undue delay — within 72 hours of becoming aware — of a personal data breach affecting your diners, and help you notify the National Privacy Commission;
• delete or return the information when you stop using TapNaDine, unless the law requires it to be kept; and
• give you the information you reasonably need to show you comply with the law.

Liability

To the extent the law allows, Zenigan Software Studio is not liable for indirect or consequential losses, such as lost sales, and its total liability to a business is limited to the fees that business paid in the three months before the claim. Nothing here limits rights that the law does not allow to be limited.

Changes and ending

We may update these terms; the date at the top shows the latest version, and we will tell business account owners about material changes before they apply. A business may stop using TapNaDine at any time. We may suspend or end access that breaks these terms.

Governing law

These terms are governed by the laws of the Republic of the Philippines.
